Under the United States and Texas Constitutions, everyone possesses fundamental legal rights. Infringing upon these rights can have a substantial effect on the result of a criminal proceeding.

Important Rights You Should Be Aware Of

Individuals who have been accused or charged with a crime have various legal rights, the following of which are extremely important and should always be invoked. They include:

Right to Remain Silent

If you get arrested and the police want to question you, they must read you your Miranda Rights.​

Invoke your Rights:

  • You have the right to remain silent.

  • Anything you say can and will be used against you in a court of law.

  • You have the right to an attorney present during questioning.

  • If you cannot afford an attorney, one will be provided for you

  • Do NOT waive your rights.

 

Once they have read you your rights, tell them you want a lawyer and stop talking to them until you have consulted with and hired an attorney.

Right to an Attorney

Every defendant has a right to counsel. If you cannot afford an attorney, the court must appoint one. Although, you have the right to represent yourself, be smart and call me.

Right to a Jury Trial

All individuals charged with crimes have the right to trial. You are presumed innocent unless proven guilty beyond a reasonable doubt. Make sure you have an attorney representing you. It is not advised to represent yourself.

Right Against Self-Incrimination

A defendant has the legal right to remain silent to prevent self-incrimination. Defendants may also testify on their own behalf. Make sure you consult with your attorney before deciding to testify or make any statement.

Right to Confront Witnesses

Individuals have the right to question and cross-examine every prosecution witness that testifies at trial. You will need an experienced trial attorney to do this for you.

Right to Produce Evidence
